Texas residents who follow celebrity divorce may know that Tea Leoni and David Duchovny have ended their marriage. The star of ‘Californication” and ‘X-Files”, his Golden Globe winning series, Duchovny, 54, filed for divorce in New York in June citing the irretrievable breakdown of their marriage according to court records.
The couple was married in 1997 and separated in 2008. Duchovny underwent treatment for a personal problem and, after several months, the couple were back together until 2011. They have two children.
Duchovny and Leoni, 48, noted for her work in ‘Deep Impact,” were able to decide on the divorce agreement privately. Leoni will have physical custody of their children, and the couple will share legal custody. According to their divorce settlement, Duchovny will pay $40,000 per month in alimony as well as $8,333 per month for child support. The agreement specifies that he is also responsible for private school, college and summer camp as well as any additional child-related expenses.
Alimony, as in this case, may be mutually agreed to by both parties. If a couple cannot agree, the court may determine what should be paid based on many factors including such things as the length of time a receiving spouse has not been employed or whether they are disabled. Child custody and the decisions that need to be made may focus on an issue like which parent will provide routine care.
An attorney may assist couples in negotiating a mutual agreement that provides for the needs of both parties and their children. If a dispute arises, an attorney may provide insight into obtaining a workable solution.
