Hillary Duff now divorced from Mike Comrie

Many Texans are probably familiar with Hillary Duff of “Lizzie McGuire” fame. The 28-year-old actress was formerly married to NHL player Mike Comrie. The marriage has ended in divorce with the issuance of the judge’s final orders on January 28.

Ms. Duff and Mr. Comrie were married in August 2010. In January 2014, the couple separated. They have a 3-year-old son together. It has been reported that the couple had a prenuptial agreement. Ms. Duff will receive the home while Mr. Comrie will receive a payment from her of $2.4 million. They will also jointly share custody of their son.

Like all other people, many celebrities have marriages that end in divorce. Unlike most, however, their divorces tend to be highly publicized, allowing the public to see details of property division, child custody, support and other orders. In Ms. Duff and Mr. Comrie’s case, having a prenuptial agreement likely made their divorce go a little smoother. A prenuptial agreement is normally designed to indicate how assets will be divided. If a prenuptial agreement is valid, judges will divide the assets according to the provisions contained in the agreement.

Prenuptial agreements cannot deal with child custody or child support. If they contain these types of invalid provisions, the court may entirely disregard them. People who are planning to marry and who want to draft a prenuptial agreement may want to get the help of a family law attorney in order to ensure that it does not contain inappropriate language.
